Chasing Trails terms and conditions

Not the most exciting bit, but please read on. By booking with Chasing Trails or purchasing a product from Chasing Trails you are agreeing with the terms and conditions below. If you have any questions/queries please feel free to contact us.

Terms & conditions for guided rides & skills courses

Bookings

– Your place is secured on a guided ride or skills course (day or evenings) when we have full payment from yourself. We will inform you at the time of booking when payment is required. Payment is usually required at the time of booking.

Price

– We guarantee not to increase the price of an activity once a booking has been received. Prices on the website are per person and are quoted in pounds sterling.

Service

– We will endeavour to provide an activity as closely resembling that described on this website or any other promotional material. Be aware that due to unforeseen circumstances some details may vary slightly, however the overall quality of the activity will not be diminished. If there has to be changes made due to weather etc the leaders’ decision will be final.

Cancellation by you

– We will try to accommodate any changes in your needs but cannot always guarantee that we will be able to do so. The cost is non-returnable, but it may be possible at our discretion for you to re-book at a later date or to give your place to a friend of similar ability. It will be your responsibility to arrange any payment between yourselves

Postponement due to factors out of our control

– if factors such as weather conditions make safety a concern, an alternative date will be agreed. Although this is rarely necessary, there will be no limit on the number of times a date can be postponed for reasons out of our control. Decisions will sometimes be made by Chasing Trails taking account of factors affecting the safety of the day and sometimes by other organisations, for example the Forestry Commission may close trails on their land due to unsafe conditions.

Hire Bikes

– The hirer is responsible for any damage or loss caused. Any damage or loss of the bicycles will be charged at full replacement/repair value. You must agree to return the bike at a certain time in the condition you received it in and may not sell, hire or otherwise part with the bike during the hire period.

Limit of liability

– Chasing Trails have a duty of care to its customers but are only liable up to the cost of your activity with us. We cannot be held responsible for damage and/or loss to your personal possessions. We are also not liable for failure in carrying out the contract if the failure is due to the action of the participant or the action of a third party. We are also not liable for any theft or damage to bicycles, or injury to you occurring as a result of cycling on or off road or in transit.

Your responsibilities

– You accept that mountain biking can be a hazardous activity and may involve elements of risk or discomfort. By agreeing to these terms and conditions you take personal responsibility for your own actions. Chasing Trails take no responsibility for damage, death or injury caused to you or by you as a result of participation. You must at all times ride within your own ability and always wear an approved safety helmet. Whether hired (from a source other than Chasing Trails) or belonging to you it is your responsibility to arrive with and keep your bike in safe working order and you must notify us of any defects as soon as possible. We reserve the right to stop you from participating if your bike is not in safe working order. If we have to provide a hire bike in order for you to participate you will be responsible for the total cost of the hire. You must be physically fit enough to participate in the activity you have chosen. If you have to drop out of the activity you will be responsible for any travel arrangements or additional costs incurred. You agree to abide by the authority of the leader of the group and act in a reasonable way for the duration of the activity. We reserve the right to remove any person from an activity whose behaviour is deemed by the leader to be detrimental to the group, unsafe or adversely affecting the groups’ enjoyment. We will not be liable for any refund in these circumstances.

Medical

– It is your responsibility to ensure that you are sufficiently fit and adequately equipped to partake in your chosen activity. You must tell us of any medical conditions or dietary requirements at the time of booking. If you are not in a suitable condition to complete an activity or are under the influence of drink or drugs the leader will ask you to leave the activity. We will not be liable for any extra expense incurred by this and you will not be able to claim a refund.

Complaints

– If you have a problem or complaint on your activity you must bring it to the attention of our staff as soon as possible and we will try to rectify the problem. If you feel that the problem was not resolved and resulted in a much-reduced enjoyment of the activity you must inform us in writing within 28 days and we will respond within 28 days to resolve the matter to the satisfaction of both parties.

Privacy

– We will not pass on your personal details to any third party except for the purposes of organizing your activity.

Staff

– Staff are trained to lead and organise activities of the nature detailed on this website. An instructor is there to ensure your chosen activity is safe and enjoyable and their instruction should be followed at all times. In the event of changing circumstances the leaders’ decision is final.
The instructor(s) will hold the Scottish Cycling Mountain Bike qualification appropriate to the activity.

Terms & conditions for bicycle maintenance and wheel building courses

Bookings

– Your place is secured on a maintenance course when we have full payment from yourself.

Privacy

– We will not pass on your personal details to any third party except for the purposes of organizing your activity.

Your responsibilities

– Chasing Trails take no responsibility for damage, death or injury caused to you or by you as a result of participation. It is your responsibility to be confident of any skills you learn on the course before carrying out any cycle repairs, servicing or maintenance. If in any doubt you should ask a professional before proceeding. Chasing Trails take no responsibility for damage, death or injury caused to you or by you as a result of participation. You must at all times work within your own ability and always wear any appropriate safety equipment. We reserve the right to remove any person from a course whose behaviour is deemed by the leader to be detrimental to the group, unsafe or adversely affecting the groups’ enjoyment. We will not be liable for any refund in these circumstances.

Terms & conditions for holidays, tours & breaks

Booking

– To secure your place you must pay the deposit per person that is quoted on the relevant page of the website. You must pay the full balance a minimum of 8 weeks before the first day of that trip. If you are booking within 8 weeks of the start date, the full amount is payable on booking. Chasing Trails reserve the right to cancel your reservation without refund of deposit should you fail to pay the outstanding balance by the agreed date. All payments must be made in pounds sterling. The deposit is non-returnable. See below*

Price

– We guarantee not to increase the price once a booking has been received. Prices on the website are per person and are quoted in pounds sterling. Prices do not include transport to the accommodation at the start of the trip or transport from the accommodation or finish location at the end.

Service

– We will endeavour to provide a holiday/trip/tour as closely resembling that described on this website or any other promotional material. Be aware that due to unforeseen circumstances parts of the holiday such as accommodation details may vary slightly. If there need to be changes made due to weather or safety the leaders’ decision will be final.

Accommodation

– Chasing Trails use a range of accommodation providers and cannot be held liable for any damages, losses or inconveniences resulting from them. We will always try to make sure these problems are minimal and will deal with any situations as they arise. Whilst you are staying with an accommodation provider you must agree to their terms and conditions.

Hire bikes

– The hirer is responsible for any damage or loss caused. Any damage or loss of the bicycles will be charged at full replacement/repair value. You must agree to return the bike at a certain time in the condition you received it in and may not sell, hire or otherwise part with the bike during the hire period.

Cancellation by you

– We will try to accommodate any changes in your needs but cannot guarantee that we will be able to do so. If you need to cancel your holiday for any reason after booking you must inform us in writing before trip start date.
The following cancellation fees apply:*

The deposit is non-returnable.
Cancellation 6 to 8 weeks before the holiday – you pay 25% of the holiday cost
Cancellation 4 to 6 weeks before the holiday – you pay 50% of the holiday cost
Cancellation 2 to 4 weeks before the holiday – you pay 75% of the holiday cost
Cancellations 2 weeks and less before the holiday – you pay 100% of the holiday cost

*However, if you can find someone who wants to take your place on the holiday, please contact us with a change of details. It will be your responsibility to collect the payment from the replacement person. We will not charge any administration fees for a change of details.

Cancellation by us

– We will always try our best to avoid cancelling a package or trip. In the unlikely event of circumstances that force us to cancel a holiday you will receive a full refund or a suitable replacement package or trip. Chasing Trails are not held liable for any additional expenses you incur through cancelling your holiday e.g. travel expenses. If there are circumstances beyond our control which cause us to cancel or change your holiday such as war, riot, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions or other circumstances that amount to force majeure we will not refund or pay you any compensation or be liable for any other expenses to you.

Insurance

– We strongly recommend that you obtain adequate travel insurance cover before joining any of our holidays or activities. This cover should be comprehensive enough to cover you for the activities you will be involved in on your holiday and also any cancellation made by you. It is important to check that the policy covers sports such as mountain biking.

The leader will hold a guiding qualification appropriate to the holiday or break.
